Summary
[edit]- Scan made 18 Oct 2007 directly from an original 1929 copy of Record 1 of the set of Sea Drift (by Frederick Delius) performed by Roy Henderson for the Decca label. The original is the property of the uploader.
- This label is a former registered trade mark of The Decca Record Company Limited.
- The image is to be used to illustrate the section 'Recording Projects' within the article on composer Frederick Delius, where the present recording is specifically mentioned as the first issued recording of this music. It may also be used to illustrate the article on the singer, Roy Henderson, and would be a useful inclusion in the article on the Decca label.
- The recording, which is 78 years old, is of great interest as a historic landmark in the issue of Delius's work, and is specially interesting because (so far as uploader can ascertain) it has never been transferred to a modern medium, was in the catalogues available only for a very short time, and is consequently quite rare and not at all well-known. The image is a visual proof of the recording's existence and appearance which could not be tendered in any other way. Its reproduction is unlikely to be prejudicial to the Decca company. Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
- It illustrates educational matter about the album from which the label illustration was taken.
- The use of the label will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies of the image could not be used to make illegal copies of the disc and label on another disc.
- It is a low resolution image.
- The image is only a small portion of the commercial product.
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
