It is considered that it is a fair use of a low resolution image to accompany an article on the work itself, My Bed, an article about the work. The work itself is of major importance and has achieved an iconic position. It is also considered by the artist to be one of her two major and "seminal" pieces of work. The use of the image helps significantly with the understanding of the topic which concerns visual art, and this understanding would be impaired without it. It is believed that this use does not infringe copyright. There is no known free alternative available. According to section 107 of the United States Copyright Act of 1976: The fair use of a copyrighted work...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.
