Fair use rationale for Bert Jansch article

[edit]

The following rationale applies only to the use of the image to illustrate the album cover in the article Bert Jansch, in the section describing the album Rosemary lane.

Although the picture is subject to copyright, it is covered by the U.S. fair use laws because:

  1. it is a low resolution copy of an LP album cover;
  2. it does not limit the copyright owner's rights to sell the album in any way;
  3. its low resolution means that copies could not be used to make illegal copies of the album artwork;
  4. the image on the cover is significant because it was made by a famous artist, Heather Jansch;
  5. its use is commensurate with usage throughout discographies and album listings across the World Wide Web;
  6. there is no free alternative available.
